Senate Dems Kill Baby Box Bill + More Bad Bills

This week, every New Mexico Senate Democrat on the Health and Public Affairs Committee tabled SB 499 Baby Box legislation, claiming it “needs work,” despite recent high-profile cases of infants discarded in the trash and a baby adopted this week from a Belen Baby Box by fireman, Lt Chris Martinez and his wife. In fact, Lt. Martinez was present when the baby box was used at his own station. “We must pass this legislation now, because every cry in a dumpster is a plea we can’t ignore,” said NMAFL’s Executive Director, Elisa Martinez in heartfelt testimony for the bill.

“We can’t wait for another baby to be found in the trash, dead or alive. I’ve been working on this legislation for years now. It’s time we listen to our constituents, prioritize this issue, and pass a Baby Box Emergency Bill so every community can offer this lifeline of hope” said bill sponsor, Senator David Gallegos. Meanwhile, in the SAME COMMITTEE, Democrats on Monday unanimously passed a deeply flawed pro-abortion bill SB 404, the Patient Records Privacy Act, that also “needs work.” New Mexico Alliance for Life testified against this dangerous bill that seeks to completely overhaul the medical records system in order to block disclosure of abortion and transgender data from healthcare professionals, as well as reporting of annual abortion rates. SB 404 sponsor, Senator Mimi Stewart claimed to be, “working on amendments,” that would be added into the flawed bill “in the next committee.” Read more below.

IN OTHER NEWS: BAD PRO-ABORTION BILLS ADVANCE!

New Mexico Democrats are pushing three bills—SB 57, SB 404, and SB 508—in the 2025 session that threaten transparency and accountability. These bills aim to hide abortion-related activities and expansion, including taxpayer-funded operations, from public scrutiny.

Elisa Martinez of New Mexico Alliance for Life offered the sole testimony against SB 57 and SB 404, which block access to records on abortions and transgender procedures: “Democrats are prioritizing unaccountable abortion expansion with New Mexicans’ taxdollars, this is a shocking and unprecedented power grab.”

URGENT: EXCLUSIVE LEGISALTIVE ANALYSIS PROVIDED BY NMAFL

**SB 57**: This bill, as admitted by the sponsor, Senate Majority Leader Peter Wirth, is aimed at shielding Dr. Eve Espey–a radical abortion activist earning a taxpayer funded salary of $530,388 annually at UNM. It ultimately will conceal Espey’s and every taxpayer funded abortion activity from public disclosure. This includes Espey’s taxpayer funded abortion expansion across the state, her plans to execute this through UNM Health Sciences Center and abortion allies were first exposed by NMAFL in November (read more here).

These plans were uncovered by NMAFL’s use of the state’s existing open records law. SB 57 blocks away any and all records that involve the practice of abortion and will even conceal any misuse of funds or potential illegal activity—like the shocking 2016 Congressional referrals against UNMHSC for mishandling fetal tissue and violating consent laws, also initially uncovered by NMAFL’s use of the state’s Inspection of Public Records Act, IPRA. SB 57 is passed the NM Senate Floor on a party-line vote, and is in the House Judiciary Committee awaiting its next hearing, contact members here by clicking on their name to vote NO on SB 57.

**SB 404**: Eliminates mandatory reporting of induced abortions entirely, no state agency would collect or publish data on induced abortions, ending a decades-long practice of tracking–including the number of taxpayer-funded abortions in NM. Eliminates access to medical records by health care professionals, including electronic records pertaining to abortion and transgender procedures. This requires a multi-million dollar overhaul of the medical records system, as noted by Dem Senator Martin Hickey, a retired physician. With New Mexico now a hub for unregulated abortions up to birth (75% for out-of-state women), this secrecy could also hide injuries, deaths, and millions in Medicaid spending. SB 404 is currently in th Senate Judiciary Commitee awaiting a second hearing, contact members here by clicking on their name.

**SB 508**: Pumps millions into expanding health facilities and mobile units including a $750k “community health center in Bernalillo county, a $1.5 million “public health office” in Doña Ana county, and a $1 million “Student Health Center” at Eastern New Mexico University. These publicly funded facilities will be used to promote ( if not perform) elective abortion and transgender procedures. Contact the Senate Tax Committee here, tell members to vote NO on SB 508.
